ANC8A01 candidate, Tom Donohue, has issued a call to action to constituents of ANC8A. After over two years Donohue asks constituents of ANC8A to demand Holly Muhammad provide anything to support claims Donohue is a racist, that he hates Black Women & Muslims. Donohue, who is vying for a seat in the upcoming election, has expressed his concerns over the alleged defiance of the law by the 8A Commissioners. He believes that it is the duty of every citizen to hold their elected officials accountable for their actions.

In a statement, Donohue said, “As a candidate for ANC8A01, I am committed to ensuring that our community is governed by individuals who respect and uphold the law. I urge my constituents to challenge the claims made by Commissioner Muhammad, and to seek the truth in this matter.”

He further added, “It is our responsibility as citizens to question the actions of our elected officials, especially when there are allegations of legal defiance. We must ensure that our community is led by individuals who are committed to maintaining the integrity of our governance.”

Donohue’s call to action comes in the wake of allegations that the 8A Commissioners have been defying DC law. These allegations, if proven true, could have serious implications for the governance of the community.

A flyer was distributed over a several block radius which included a photo and made claims he was a scammer and that he bullied females.
  • Residency Fraud: Muhammad is alleged to have falsified her residency to maintain her eligibility as an ANC commissioner after moving out of her district. She declared her candidacy using the address of fellow Commissioner Barbra Clark.
  • False Accusations: In retaliation against Tom’s defamation lawsuit, Muhammad filed false stalking charges against him, which were later dismissed by a judge.
  • Evasion of Legal Process: A process server made multiple unsuccessful attempts to serve Tom’s lawsuit at Muhammad’s declared address, raising further questions about her residency.
  • Collusion and Cover-up: Other commissioners are alleged to be complicit in Muhammad’s actions, including ignoring her residency fraud and actively attempting to silence Tom and suppress information about the situation.

I trust this message finds you well. I recently reached out to all those who have expressed their intention to run for the ANC8A Commissioner positions. I felt compelled to underscore the significance of their potential candidacy against the incumbent ANC Commissioner in each single-member district.

Please understand that the following information is not a reflection of my personal views, but rather a documented fact. It has come to light that the entire Commission has failed to adhere to the directives issued by the Board of Elections. Specifically, they have neglected to convene a special meeting to address the residency conflict of ANC 8A03 Commissioner Holly Muhammad.

I believe it is crucial for you, as potential candidates, to be aware of this situation. It is my hope that this knowledge will inform your campaign strategies and future actions, should you be elected.

I am Tom Donohue, a hopeful contender for the ANC8A01 seat. I am reaching out to introduce myself, as we have not yet had the pleasure of meeting. Although this is my maiden voyage into the political arena, I have been actively involved in our community and am a staunch advocate for transparency within our Commission.

Regrettably, I have observed a disconcerting trend among our current commissioners, who have consistently neglected to address a critical issue. This has led me to the unfortunate conclusion that there may be corruption within our ranks, necessitating a comprehensive overhaul of our Commission. This is where your candidacy becomes crucial, offering the potential for fresh perspectives and increased engagement.

I am uncertain as to how closely you have been monitoring the questionable conduct of our current ANC Commissioners, but I felt it necessary to bring a particular incident to your attention. Each commissioner has chosen to disregard two letters from the DC Board of Elections, advising them to convene a special meeting to discuss the residency of ANC 8A03 Holly Muhammad.

Ms. Muhammad, my former ANC Commissioner in 8A01, relocated without informing anyone a few months prior to the 2022 election. Upon learning of her move, I alerted the Board of Elections. Subsequently, Ms. Muhammad updated her address with the BOE, indicating she resided at a property on Minnesota Ave, owned by Barbra Clark, the current Commissioner for ANC8A02 and a friend of Ms. Muhammad’s. Ms. Clark allowed Ms. Muhammad to use the address of a second property she owns as her updated residency, coinciding with a commissioner who was not running for re-election in 8A03. Ms. Muhammad declared her candidacy using Ms. Clark’s address, ran against a candidate who was a bona fide resident of 8A03, and won. This, in my view, constitutes an unjust usurpation of an election from a legitimate candidate.

As of this moment, neither Ms. Clark nor Ms. Muhammad has announced their intention to run for re-election. I suspect that the delay is due to Ms. Muhammad’s address issue, as she is likely aware that her candidacy will be immediately challenged.

I assure you that I do not make these claims lightly. I am attaching two letters from the Board of Elections, which Chairwoman White has refused to acknowledge or address, and three sworn affidavits from a process server who attempted seven times (including one of them during an actual ANC Meeting where I informed her via chat that a process server was at her door) to deliver a complaint to Ms. Muhammad at the aforementioned address, without success. I am also including a link to a conversation with ANC8A01 Commissioner Tanya Crawford, who confirmed that Ms. Muhammad does not reside at the address she provided.

I am hopeful that we can usher in a new era of commissioners next year, sending a strong message to our community that such behavior will not be tolerated. I firmly believe that we have the potential to be a Commission that sets a standard for the district and serves as a role model for future 8A and other commissions across the district.

For the sake of transparency, I wish to disclose that I currently have a civil complaint against Ms. Muhammad for defamation, following her unfounded allegations of being a racist that I hate black women and Muslims.  After two years of making these false claims in her response to a recall petition I filed against her she has not provided me or anyone else one example to support her claim she has made both in writing and verbally during ANC Meetings. Mendelson to Board of Elections: Investigate ANC Commissioners Residency

During July’s Meet Up With Mendelson, DC Council Chairman Phil Mendelson said in his personal view the BOE should enforce and investigate ANC Commissioners who don’t live in the single-member district to which they were elected.

How did we get here? On February 17, 2023, The DC Board of Elections received, by mail, a request for an investigation into the qualifications of Commissioner Holly Muhammad by Tom Donohue a ten-year resident of ANC8A01, and small business owner.  Mr. Donohue asked for an investigation on the grounds that Commissioner Muhammad does not reside in Advisory Neighborhood Commission Single Member District(ANC-SMD) 8A03 at 1915 Minnesota Ave, SE, 20020. He submitted materials including sworn affidavits by process servers declaring neighbors telling them Ms. Muhammad did not live there.  Additionally, they made seven attempts to contact her including one during an ANC meeting, which all failed as she was not home.

On April 25, 2023, Registrar of Voters, Marissa Corrente sent ANC8A Chairwoman Jamila White a letter stating,

“Pursuant to DC Official Code § 1- 309.06(f)(2), a vacancy in an ANC is a matter for the ANC to determine. The code specifies the ANC should hold a special meeting to consider the seat in question. The code states:”

 to which Chairwoman White responded, “According to the statute included, a meeting is needed if we have determined a vacancy, and we do not have a vacancy.”  A second letter was then sent by Ms. Corrente saying, ”Please note that since I last reached out, the Election Modernization Act has become law which now changes DC Official Code § 1- 309.06(f)(2 )…

Considering the statute update, I refer this matter back to ANC 8A for deliberation at a properly noticed ANC meeting as is required by law.”

As of the date of this posting, no known response had been made.

On Father’s Day 2023, ANC8A01 Commissioner Tanya Crawford engaged in a conversation with Donohue while he was livestreaming a block party that the commissioner was hosting.  In this conversation, Crawford approached Donohue while standing next to his camera and tripod and is clearly heard saying “I’m gonna be honest with you Holly Muhammad doesn’t live over here.. look she don’t live over here… She don’t live here, she don’t live here”

Washington, D.C. – On Father’s Day, during a block party that was being live-streamed to Facebook,  ANC8A01 Commissioner, began a conversation with a neighbor and small business owner, Tom Donohue where the commissioner had openly admitted to her knowing that ANC8A03 Commissioner, Holly Muhammad does not live where she declared her candidacy for ANC Commissioner and claims she currently lives.  

In the recording released today, Crawford says, “Listen, I want to talk to you because I’m gonna be honest with you, Holly Muhammad doesn’t live over here” She can also be heard saying “She don’t live over here, she don’t live over here”

Donohue has claimed Muhammad does not live where she says and that fellow ANC8A Commissioner and friend Barbra Clark permitted Holly to use her address early last year to run for the open ANC8A03 seat.  “It’s been clear that Holly & Barbra conspired together in order to keep Holly as Commissioner, likely to keep access tight and information secret,” Donohue says, he continues “that makes sense as no one has provided information that I have requested in multiple Freedom of Information Act Requests pertaining to the financials over the last three years, they all have been ignored.”

For years ANC8A under Holly, now Jamila White’s presidency, this commission has ignored and refused to inform the voters of this commission what is really going on.  Twice – the Board of Elections has advised the commission to host a special meeting to determine whether a vacancy exists.  This advisement was rejected by Chair White saying, “According to the statute included, a meeting is needed if we have determined a vacancy, and we do not have a vacancy.”  Additionally, time and time again this commission has prevented Donohue from informing the voters of matters concerning the commission, or even just asking questions. 

As a result, Donohue filed a complaint with the DC Board of Ethics & Government Accountability (BEGA) that complaint is currently under investigation.  On Monday, June 26, 2023, Donohue filed a complaint with the Department of Justice Civil Rights division claiming his rights were violated when the commission on multiple occasions either refused to allow him to speak, muted him in attempts to silence him, deleted messages sent during a public meeting removing it from the public record and went so far as to declare publicly during an ANC meeting that he was banned.

Donohue said in a written statement that “the voters of ANC8A need representation from elected officials that will follow the law, will respect the rights of their fellow neighbors, and be accountable to the public.  That means listening to people. not jam-packing a meeting full of speakers and not providing more than 15 minutes to hear the concerns of their neighbors.  ANC8A must hold a hearing and declare ANC8A03 vacant and remove Holly Muhammad from office.”

Evidence and legal filing ssupport that Commissioner Muhammad is using the physical address of friend and fellow ANC8A Commissioner Barbra J. Clark as her own in order to run and remian a ANC commissioner. In an unprecidented move by the Commissioners of ANC8A and after being advised not to, ANC8A announced during its May 2023 public meeting that they were banning constitutent Tom Donohue a 10 year Ward 8 small business owner for being disruotive ( in a virtual ANC meeting whwre he’s never been permitted to raise these issues)

ANC 8A03 Commissioner Holly Muhammad lied. She made up fake instances of ‘stalking’ with nothing to corroborate her stories no police report – nothing. My GPS positions compared to the places Holly clains I was indicate I was no where near her. She lies. She continues to lie about where she lives. It’s a damn shame.

In a case where lies were the basis of a anti-stalking claim from Commissioner Holly Muhammad, the Judge read right though them and dismissed Commissioner Muhammad’s anti-stalking case against him. After Ms. Muhammad’s attorney completed her side Donohue asked the Judge how he should proceed in introducing his side thats when the Judge proceeded to make her decision on Donohue’s already filed Motion to Dismiss. This Judge could not have read this case any better, She understood the right of a voter and see saw right through the lies Ms. Muhammad attempted to put against Donohue. Donohue was prepared to counter each claim by showing his GPS location via Google location which tracks Donohue’s every move and has for years. There is no possible way Donohue was where Ms. Muhammad says he was she simply was lying lying in order to endanger Tom’s career and well being. The Judge saw right past her. She went on to say…

Okay, so I, I I, I am looking at the testimony in the, in the light, most favorable to the petitioner. And I know Mr. Donohue was self-represented, but, uh, I do know that there, both parties have filed motions to dismiss. I am looking at the statute, um, even looking at the evidence most favorable to the petition. I don’t see how counsel will make a case for stalking. First of all, counsel’s exhibit number one shows that the school is directly in front of the respondent’s home.

He comes out of his home, he sees the school, the camera is on the opposite angle of the corner where everything as apparently happened. Don’t see, you don’t see the, uh, petitioner in any of the videos. What you see is the respondent coming on it with his dog walking across the street, stay, staying in the street, now going on 22nd, turns into his street, the dog goes to the bathroom, he picks up the dog poop.

He continues to walk, and he puts the dog back into his apartment. Um, appears to head towards the school. It appears that that may be a voting site. This was a public event. It was open to the public. Uh, she is a, um, public figure. She’s on the ballot, she’s campaigning. Um, and he says statements to her, which I don’t believe could be interpreted as a threat, uh, given the fact that she’s on the ballot and he’s telling her like, what’s gonna happen later on tonight? Meaning, that’s when the results are happening from the elections.

It’s a, it’s a completely understandable meaning of that. Um, but even if it was a threat, one threat does not really make a course of conduct. Um, and so assuming it was a threat, and I don’t believe it was, um, but assuming in the light most favorable to the petitioner that it was a threat, that doesn’t necessarily mean stalking the other two incidents of the Safeway.

They li apparently live in the same community. He happens to go in the Safeway. There is no, uh, corroborating evidence regarding that. There’s no corroborating evidence of him showing up at the home. She wouldn’t say what, where she resides. There was an objection. So it was really difficult for the court to even know how he would know where she resides at. Um, there’s really no, nothing on the record. There is no, um, allegation that there has been anything other than, you know, constituents not agreeing with their elected official, maybe going toe to toe, making some sort of civil complaint.

As, um, Mr. Donohue alluded to, um, as, as the, um, basis for this, uh, filing, which is, uh, context, which is, uh, in, in retaliation for him taking some steps. I don’t understand what that is, but, um, it’s pretty clear that there, there’s not a course of conduct.

And even if there were, there’s really no intent for Mr. Donohue who he appears to live in the community. He’s obviously engaged, uh, civilly in his, uh, form of government and is, uh, um, at the convention center during a public event. Uh, uh, well, um, he alleges to take pictures of he was hired even if it, that wasn’t the case. I mean, this is a big event in DC The mayor’s being sworn in, the, uh, public is invited. Parties can’t appear with cameras. Uh, the, uh, petitioner, in this case, is a public figure.

People are gonna take pictures, uh, of public figures. They’re gonna disagree with their, our stance on certain, um, certain topics. And, um, believe that that’s kind of like who here, democracy works. I don’t believe that in this case, the petitioner, even in the light, most favorable to her has been her burden with the four allegations of the court of conduct, assuming that she had, I don’t find that the intent for Mr.

Donohue, whether she’s proving any **unknown few words** to cause her to fear for her safety, safety of another person, feel seriously alarmed, disturbed, or frightened, or suffer emotional distress. Uh, there’s just nothing to indicate that or that Mr. Donohue would have, or any reasonable person would have conceived that to be the reaction given the interaction. Um, at a voting poll, people are going in to vote. They may not like the candidate. They may say some things. It wasn’t, even if it was a threat, it wasn’t reported to the police. None of these incidents were reported to the police.

Um, and for two of them, there’s really no corroborating evidence. So at this point, I don’t believe that the petitioner has made a burden. I am gonna grant Mr. Donohue his motion to dismiss.
